Questionnaire terms and confidentiality
Version 1.0
- 1. Who we are. These terms are between you, the business named on the questionnaire, and Hangar 19 Ltd trading as ParkRecharge, company number 08823360, whose registered office is [registered office, to be confirmed] ("ParkRecharge", "we").
- 2. Purpose. We use the questionnaire to assess businesses for our panel of installer and civils partners. Completing it is not an application for a contract and does not create one.
- 3. No commitment. We are not obliged to appoint you or anyone else, to give you any work, to give reasons for our decisions, or to continue the process. We may change, pause or end the process at any time. Nothing here is exclusive: you can work with others and so can we. We do not pay for the time or cost of completing the questionnaire.
- 4. Your answers. You confirm that the information you give is accurate and complete to the best of your knowledge, that you are authorised to submit it for your business, and that sharing your documents does not breach anyone's rights or confidentiality (please remove customer details first). We may check your answers with Companies House, accreditation bodies, insurers and public sources, and ask follow-up questions. Please tell us if anything changes before we appoint. Misleading information may lead to your response being excluded.
- 5. Confidentiality. Each of us will treat as confidential the non-public information the other gives us through the questionnaire or related discussions, including, for us, our site lists, specifications, volumes, customers and pricing approach, and, for you, your rate cards, methods and documents ("Confidential Information"). The receiving party will use it only to assess and, if it happens, arrange an appointment; keep it secure; and share it only with staff, advisers and subcontractors who need it and are bound by similar duties. This does not apply to information that is public through no fault of the receiving party, was already known to it, was independently developed, was lawfully received from someone else, or must be disclosed by law or a regulator (with notice where the law allows). You must not use our information to approach our customers or sites, or share it with other installers. This duty lasts [2 years] from the date you submit. On request we will return or delete the other's Confidential Information, subject to legal retention. For installers we shortlist, we may ask for a signed mutual non-disclosure agreement before sharing more sensitive information.
- 6. Fair process and competition law. You must not share with, or ask other participants for, prices, rates, territories, customers or bids. We will not disclose your information to other participants.
- 7. Documents and intellectual property. You keep ownership of what you submit. You allow us to copy and use it internally, and to share it with our advisers, only to assess and arrange appointments. We will not publish it. Our specifications and site lists remain ours and may be used only to respond to us.
- 8. Personal data. We use the names, contact details and other personal data in your response as controller, to run this process, contact you and manage supplier relationships, on the basis of our legitimate interests and steps before a contract. We keep contact details in our customer records and may share them with service providers who help us. We keep responses for [24 months] after the process closes unless we appoint you, in which case for the relationship and [6 years] after. You have the usual rights over your data under UK data protection law; contact [privacy contact]. You confirm you have told any colleagues whose details you give us. See our privacy notice at [link].
- 9. Liability. Nothing limits liability for fraud, death or personal injury caused by negligence, or anything that cannot be limited by law. Otherwise we are not liable for costs, losses or lost opportunities arising from this process or our decisions. Information we give you is to help you respond and we give no promise that it is complete.
- 10. Access and security. Anyone with your private link can see and edit your response, so keep it safe and share it only with colleagues. We may replace a link at any time. Do not try to see anyone else's response, and do not upload anything that contains malware.
- 11. Deadline. The deadline is shown on the form. After it the form locks, and we may extend it for everyone.
- 12. General. These terms cover this questionnaire only and do not replace any later contract or non-disclosure agreement. They are governed by the law of England and Wales and the courts of England and Wales have exclusive jurisdiction. No one other than you and us has rights under them. If part is unenforceable, the rest stands.
- 13. Acceptance. By ticking the box when you start, and again when you submit, you accept these terms for your business and confirm you have authority to do so. We record the date, time, version, and your name and email.
